These Terms of Use (“Terms”) govern your access to and use of the Fleet Rocket Transportation Management System (“TMS”) cloud platform and related services (collectively, the “Services”), provided through https://fleetrocket.io (the “Website”). Fleet Rocket (“we,” “us,” or “our”) is a brand owned and operated by Freight Technologies, Inc. (“Fr8Tech” or the “Company”), registered in the United States and Mexico.

By accessing or using the Website or Services, you acknowledge that you have read, understand, and agree to be bound by these Terms. If you do not agree, do not access or use the Website or Services.

1. Eligibility and Acceptance

By using the Services, you represent and warrant that:

Fleet Rocket is a cloud-based TMS designed to support logistics workflows, including but not limited to carrier management, shipment coordination, route planning, and operational analytics. Access to the Services may be subscription-based or governed by a separate commercial agreement your organization has with us.

3. Account Registration and Security

To use certain features, you must create and maintain an account.

Accuracy of Information: You agree to provide accurate and current account information and update it as needed.
Credential Security: You are responsible for maintaining the confidentiality of your login credentials.
Account Activity: You are responsible for all actions taken under your account.
Unauthorized Access: Notify us immediately at info@fleetrocket.io if you suspect unauthorized use or security breaches.

We may suspend or disable accounts to protect security or enforce compliance.

4. Permitted Use and Restrictions

You may use the Services solely for legitimate business purposes and in accordance with these Terms.

9. Limitation of Liability

To the fullest extent permitted by law:

Fr8Tech is not liable for indirect, incidental, consequential, special, exemplary, or punitive damages, including loss of profits, revenues, business opportunities, or data.
The maximum total liability of Fr8Tech for any claim arising out of or related to the Services will not exceed the total fees paid by you in the twelve (12) months preceding the event giving rise to the claim.

10. Indemnification

You agree to defend, indemnify, and hold harmless Fleet Rocket, Freight Technologies, Inc., and their officers, employees, agents, and affiliates from any claims, damages, liabilities, and expenses arising from:

Your use of the Services,
Your violation of these Terms, or
Your violation of applicable law or third-party rights.

11. Termination

By You:

By Us:

We may suspend or terminate access if you:

Violate these Terms,
Fail to pay the required fees,
Engage in unlawful or harmful activities.

Effect of Termination:

Your right to access the Services ceases immediately.
We may retain certain data as required or permitted by law and our Privacy Policy.

12. Governing Law; Dispute Resolution

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.
Any dispute will be resolved through binding arbitration administered by the American Arbitration Association.
The arbitration will be held in Houston, Texas.
You waive any right to participate in class actions or class arbitration.

13. Changes to These Terms

We reserve the right to modify or update these Terms at any time.
Updates become effective when posted to the Website.
